Terms of Service

1. The agreement

These terms govern use of Whizz Desk, operated by Whizz Tech, Office 218, Binghatti Azure, JVC, Dubai, UAE("we", "us"). By creating an account or calling the API you accept them on behalf of yourself and, where applicable, your organization.

2. The service

Whizz Desk is a recruiting platform: hosted career pages and application intake, AI-generated job descriptions, AI-assisted CV screening with evidence citations, interview kit generation, job distribution to third-party boards, and an API and dashboard to run it all. Screening is asynchronous: requests return a run that reports per-stage progress and completes with a result or a failure.

3. Your role in hiring decisions

The service scores, ranks, and recommends. It does not — and by design cannot — reject a candidate. You agree that:

  • employment decisions (advancing, rejecting, hiring) are made by your personnel, not by the service;
  • you will review AI recommendations rather than adopt them mechanically, particularly for candidates you reject;
  • you are responsible for complying with the employment and AI-hiring laws of the jurisdictions where you recruit — including any required candidate notices, consents, or bias-audit obligations. We provide supporting artifacts (decision logs, disclosure templates, evidence records); they are tools, not legal advice.

4. Candidate data

For candidate personal data you are the controller and we are your processor, as described in the Privacy Policy. You warrant that you collect and process candidate data lawfully, configure retention appropriately, and respond to candidate rights requests. We will assist with candidate requests routed to us and will never sell candidate data or use it to train models.

5. Accounts and keys

You are responsible for activity under your organization, including all API keys issued to it. Keep keys secret; rotate any key you believe is exposed. We may suspend keys involved in abuse while we investigate.

6. Credits and billing

  • Usage is metered in credits at the prices posted on the pricing page at the time of the request: currently 1 credit per CV screened, 3 per deep screen, 12 per interview kit, 0 for JD generation.
  • Credits for failed runs are refunded to your ledger automatically.
  • Plan credits reset each monthly cycle; purchased pack credits do not expire.
  • Trial credits are a one-time grant, carry no cash value, and may not be transferred.
  • Active-job limits per plan are enforced; published limits are the real limits.
  • Fees are non-refundable except where these terms or applicable law say otherwise.

7. Acceptable use

You agree not to use the service to:

  • screen people for anything other than a genuine hiring process — no surveillance, tenant screening, credit decisions, or other out-of-scope profiling;
  • configure rubrics or knockouts that target legally protected characteristics, directly or by obvious proxy;
  • upload CVs or personal data you have no lawful basis to process;
  • post fraudulent or deceptive job listings;
  • probe, overload, or circumvent rate limits or security controls;
  • resell raw API access without our written agreement.

8. Output accuracy

The engine is built to reduce model error — anonymized inputs, pointwise rubric scoring with repeated passes, and evidence quotes validated verbatim against the CV text — but language models can still be wrong, and a score is an assessment of a document, not a person. Screening outputs are recommendations delivered for human review. We are not liable for employment decisions you make.

9. Distribution channels

Job boards are third parties with their own policies and approval timelines. We show per-channel status honestly (live, pending, error) and do not guarantee acceptance, placement, or traffic on any external board. Sponsored placements are billed at pass-through cost from your own budget.

10. Availability

We aim for high availability but the service is provided "as is" and "as available", without warranties of any kind, express or implied, including merchantability, fitness for a particular purpose, and non-infringement. Scheduled maintenance and third-party model or board outages may affect the service.

11. Liability

To the maximum extent permitted by law, neither party is liable for indirect, incidental, special, or consequential damages, and our total aggregate liability under these terms is limited to the amounts you paid us in the twelve months before the claim arose. Nothing in these terms excludes liability that cannot be excluded by law.

12. Termination

You may stop using the service and close your account at any time; your data — including candidates, applications, scores, and decision logs — is exportable to CSV on every plan before you go. We may suspend or terminate accounts that materially breach these terms, with notice where practicable. On closure, data deletion follows the Privacy Policy, including its retention rules for decision records.

13. Governing law

These terms are governed by the laws of the United Arab Emirates as applied in the Emirate of Dubai, and disputes are subject to the exclusive jurisdiction of the Dubai courts. If you require an enterprise agreement with different terms — DPAs, SCCs, custom liability caps — contact support@whizztech.ai.

14. Changes

We may update these terms; material changes are announced by email to organization owners at least 14 days before taking effect. Continued use after that date is acceptance.
